Justice Dept Admits to Over 50 Violations in NJ Immigration Detention Cases
February 18, 2026
The Justice Department told a federal judge that it violated more than 50 court orders in New Jersey immigration detention cases, as revealed in a court-ordered review by a senior DOJ official.
The violations included 17 detainee transfers despite court orders prohibiting movement, actions described as accidental due to logistical delays.
Another detainee, Jorge Moran-Rodriguez, was flown to Peru in violation of a court order because of an inadvertent administrative oversight, and he chose to stay in Peru rather than return to the United States.
Judge Michael E. Farbiarz directed the administration to list every instance of noncompliance in the district since December 5, detailing 52 violations across 547 cases.
The disclosure fits a broader pattern of government noncompliance in immigration cases that has drawn nationwide scrutiny from judges who have criticized a perceived 'lawless approach' and have summoned senior officials to explain lapses.
